  1. Who is included in the Blood Reagents Class?

    The Classes includes persons and entities that purchased Traditional Blood Reagents in the United States directly from either of the Defendants, Ortho or Immucor, during the period from january 1, 2001 through October 19, 2015.

    Even if you meet these requirements, you are not a member of the Litigation Class if you are a federal governmental entity, a Defendant, or a Defendant’s parent, subsidiary, or affiliate.

  2. In return for remaining in the Classes, what did I give up?

    By remaining in the Classes, you are bound by any decision of the Court in this case, and you gave up your rights to sue Ortho and Immucor about the same legal claims involved in this case. By remaining in the Classes, you are eligible to receive a share of any money in the Combined Settlement Fund.

  3. Can I get out of (Exclude myself from) the Classes?

    If you are a Class Member, you can no longer exclude yourself.  Furthermore, Plaintiffs reached a settlement with Ortho and Immucor to end the litigation on behalf of the Class.  For additional information regarding the Ortho Settlement please see the Ortho Settlement Agreement found here.  For additional information regarding the Immucor Settlement please see the Immucor Settlement Agreement found here.

    If you elected to exclude yourself from the Ortho or Immucor Classes, you are not legally bound by any judgment or decision in this case and will remain free to pursue any legal rights you may have against them. If you are excluded from the Ortho and/or the Immucor Classes, you will not receive any money or other benefits from the Settlements.  However, you must exclude yourself from each class in order to retain your rights.  Your exclusion from one of the Settlements does not affect your rights to participate in the other.

  4. How do I submit a claim?

    We are mailing claim forms to known class members on or before December 22, 2018.  The Claim Form must be filed out completely, including your tax identification and signature and returned to the Claims Administrator on or before February 20, 2019.

    You can submit your claim by returning it via First-Class mail to:

    Please keep a copy of your completed Claim Form and any submitted documents for your records.

  5. How do I dispute the pre-populated purchase totals on my Claim Form?

    If you are accepting the pre-populated calculation of your Traditional Blood Reagents on your claim form, then you need only complete and sign form and return it to the Claims Administrator on or before February 20 2019. However, if you are supplementing or disputing the pre-populated amounts on the Claim Form, you must complete the form and also submit your supplement or dispute in writing indicating what information you dispute and attaching documentation supporting the requested corrections.  We will accept financial reports created by your company-wide accounting program, we will not need to receive invoices, receipts or other proofs of purchase unless you are unable to provide financial reports.

  6. What happens if I did nothing?

    If you are a member of the Class and you chose to take no action, your interests as a member of the Class will be represented by the Plaintiffs and Class Counsel and you will be bound by any decision or judgment entered by the Court. You will not be able to start or continue with a lawsuit against Ortho regarding the claims described herein. If the Litigation Class is successful at trial on issues common to the class, you will be entitled to present evidence of your Traditional Blood Reagents purchases from the Defendants within the Class Period in order to potentially recover any overcharges you may have paid (net of attorney fees and expenses, which may be determined by the Court to be payable from the recovery). In addition, you will have an opportunity to present evidence in support of a claim of fraudulent concealment, in order to toll the statute of limitations that might otherwise bar some or your entire claim to recover for any overcharges. As a member of the Litigation Class, you will not be responsible for attorneys’ fees or litigation expenses.
